NOTICE OF FORECLOSURE SALE UNDER POWER
LUMPKIN COUNTY, GEORGIA
Under and by virtue of the Power of Sale contained in a Security Deed given by John F. Bishop to Mortgage Electronic Registration Systems, Inc., As Grantee, As Nominee For SunTrust Mortgage, dated December 29, 2003, and recorded in Deed Book Y32, Page 253, Lumpkin County, Georgia Records, as last transferred to SunTrust Bank by assignment recorded on August 16, 2019 in Book 1431 Page 210 in the Office of the Clerk of Superior Court of Lumpkin County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of One Hundred Five Thousand Four Hundred Seven and 0/100 dollars ($105,407.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Lumpkin County, Georgia, within the legal hours of sale on November 5, 2019, the following described property:
All that tract or parcel of land, together with any improvements thereon, lying and being in Land Lot 154 of the 12th Land District, 1st Section, Lumpkin County, Georgia, and being more fully described and delineated as Tract B, consisting of 2.14 acres, more or less, according to a plat of survey prepared May 13, 1998, revised August 18, 1998, by Donald O. Babb, Georgia Registered Surveyor, which is recorded in Plat Cabinet One, Slide 22, Page 32-B, Lumpkin County, Georgia Plat Records. Said plat is incorporated herein by reference for a more complete description of the subject property and for all other legal purposes.
Subject to any and all easements, rights of way, protective or restrictive covenants, or public utilities of record, including, but not limited to, a Right of Way Deed in favor of Amicalola Electric Membership Corporation, recorded in Deed Book S-17, page 289, Lumpkin, County, Georgia Deed Records.
This being the same property conveyed from Shirley Roach to John Bishop by Warranty Deed dated November 6, 2003 and recorded in Deed Book T-32, Page 81, Lumpkin County, Georgia Deed Records.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorneys fees (notice of intent to collect attorneys fees having been given).
The entity having full authority to negotiate, amend or modify all terms of the loan (although not required by law to do so) is: SunTrust Bank they can be contacted at (800) 443-1032 for Loss Mitigation Dept, or by writing to 1001 Semmes Avenue, Richmond, Virginia 23222, to discuss possible alternatives to avoid foreclosure.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
To the best knowledge and belief of the undersigned, the party in possession of the property is John F. Bishop or tenant(s); and said property is more commonly known as 115 Tobacco Pouch Creek, Dahlonega, GA 30533.
The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code (2) final confirmation and audit of the status of the loan with the holder of the security deed and (3) any right of redemption or other lien not extinguished by foreclosure.
