Under and by virtue of Power of Sale contained in Security Deed from Terry Harold Cash and Angela Wilson Cash to Mortgage Electronic Registration Systems, Inc., as nominee for First Franklin a Division of Nat. City Bank of IN, dated April 27, 2006, filed for record May 15, 2006, recorded at Deed Book 37, Page 324, Lumpkin County, Georgia Records, in the original principal amount of $118,150.00; as assigned to Residential Funding Company, LLC, by Assignment dated July 27, 2012, filed for record August 8, 2012, recorded at Deed Book 1221, Page 81, aforesaid records; as assigned to 21st Mortgage Corporation, by Assignment dated July 1, 2013, filed for record August 7, 2013, recorded at Deed Book 1255, Page 156, aforesaid records; as modified by Loan Modification Agreement dated May 1, 2008, filed for record April 30, 2009, recorded at Deed Book 1129, Page 173, aforesaid records; as further modified by Home Affordable Modification Agreement dated March 16, 2011, filed for recordApril 4, 2011, recorded at Deed Book 1184, Page 687, aforesaid records to secure the obligations of Grantor to Lender as set forth in a Promissory Note (Note) of even date as amended, modified, or revised from time to time, with interest at the rate specified therein, there will be sold, by the undersigned at public outcry to the highest bidder for cash, before the Courthouse Door at LUMPKIN COUNTY, Georgia, within the legal hours of sale on the first Tuesday in February 2021, the following described property:
All that tract or parcel of land lying and being in Land Lot 49, 1st District, Lumpkin County, Georgia, and being more fully described by a plat prepared by James N. Cash, Ga. Reg. Sur., dated June 2, 1999, as Tract I, containing 3.00 acres, more or less, and Tract II, containing 3.165 acres, more or less, said plat being recorded in the Clerks Office of the Superior Court of Lumpkin County, Georgia, in Cabinet One, Slide 31, Page 10, said plat and the records thereof are herein incorporated for a full and complete legal description.
Said legal description is controlling however, the property is commonly known as 2636 Post White Hill Road, Murrayville, Georgia 30564.

The indebtedness secured by said Security Deed has been and is hereby declared due because of default under the terms of said Security Deed and Note, including, but not limited to, the nonpayment of the indebtedness as and when due. The indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including attorneys fees and other payments provided for under the terms of the Security Deed and Note.
Said property will be sold subject to the following items which may affect the title to said property: all zoning ordinances; matters which would be disclosed by an accurate survey or by inspection of the property; any outstanding taxes, including but not limited to, ad valorem taxes, which constitute liens upon said property; special assessments; and all outstanding bills for public utilities which constitute liens upon said property; To the best of the knowledge and belief of the undersigned, the party in possession of the property is Terry Harold Cash and Angela Wilson Cash, and/or tenant(s).
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the United States Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed. 21ST Mortgage Corporation, and its counsel are acting as debt collectors.
